The case regarding the fight between football player Arda Turan and singer Berkay Şahin on October 10, 2018 at an entertainment venue in Sarıyer Emirgan was decided on September 11, 2019. The Istanbul 41st Criminal Court of First Instance acquitted Arda Turan on charges of “sexual harassment” against Özlem Şahin. The court sentenced Arda Turan to a total of 2 years, 8 months and 15 days in prison for “shooting with a gun in a way that causes fear, anxiety or panic”, “Possessing an unlicensed gun” and “Deliberate injury”. However, it was decided to postpone the announcement of the verdict for these crimes. It was decided that there was no room for punishment because Berkay Şahin was committed against Arda Turan for “insult”.
THE COURT OF APPEAL REMEDY
After the decision, Berkay and his wife Özlem Şahin objected to the acquittal decision for “sexual harassment” through their lawyers. Istanbul 25th Regional Court of Justice, which evaluated the objection, also ruled that the decision of the local court was reversed. In the decision of the Court of Appeal on 19 November 2020, Arda Turan said that she did not know Özlem Şahin before the incident and did not know her marital status, but Berkay Şahin and her husband Özlem Şahin had previously sat and ate at the same place with Arda Turan, It was stated that they said they knew each other. It was noted that a conversation between Arda Turan and Özlem Şahin was confirmed by the statements of both parties, and that Arda Turan apologized for being hit. In the decision, it was emphasized whether the content of the conversation passed between the parties could be heard by the witnesses due to the crowded environment, and if they heard it, it was necessary to ask the witnesses. In addition, it was noted that Özlem Şahin’s stance and attitude after the speech should be asked from the witnesses, and whether there was any past-based animosity or conflict of interest between the parties should be explained separately by asking the parties and the witnesses. It was stated that the decision was made with incomplete investigation without their statements as witnesses.
THE FILE HAS BEEN SENT TO THE LOCAL COURT AGAIN
In the decision, it was also stated that if it is concluded that the crime of “sexual harassment” is over, it should be re-evaluated in terms of “simple trial procedure” for Arda Turan. The higher court, which saw the application for appeal in place, ruled that the decision was reversed and sent to the local court for re-examination and decision. Berkay Şahin and Özlem Şahin’s lawyer Umut Köroğlu said, “There were missing issues, our objection that the decision was made without sufficient research was accepted. The trial will continue in terms of sexual harassment.”
OF THE CLAIM
In the incident that took place on October 10, 2018 at an entertainment venue in Sarıyer Emirgan, Arda Turan was alleged to have sexually harassed Özlem Şahin by saying “You are a beautiful woman. I would not kidnap you if you were not married”. Later in the fight, Arda Turan headed Berkay, was taken away by the people in the environment and taken to the hospital, Arda Turan, who went to the hospital, handed the unlicensed gun to Berkay and said, “I did not know that you were your wife, I did not know the aunt. Arda said, “You can shoot if you want”, and Berkay took the pistol from Arda’s hand and left it on the seat and insulted him saying “There is no need for more disgrace. You will accept your mistake.” It was also said that “We cannot …….”, fired towards the ground, there were people coming to the room upon the sound of guns, Berkay sent people coming, and Arda left the hospital.
